Pre-orders: records, withdrawal rights and delivery delays

Understand the scope
This article provides general information about consumer orders with commercial online retailers in a German-law context. It is not legal advice and does not decide individual cases. Private sales, other countries and specific product categories may involve different rules. For a disputed order, contact a consumer advice service or qualified legal adviser. The linked statutes are starting sources. Neither a retailer description nor a comparison service replaces checking the actual agreement and the rules that apply to your particular transaction.
Distinguish withdrawal from cancellation
Distance contracts generally carry a statutory right of withdrawal under section 312g of the German Civil Code, subject to exceptions. Section 355 describes a generally fourteen-day period, while section 356 includes rules on when it starts for goods. A voluntary retailer cancellation policy is a different basis from statutory withdrawal. The label “pre-order” does not settle these questions on its own. Read and retain the withdrawal instructions with your order. If unsure, establish the appropriate declaration rather than simply returning a parcel without explanation.
Document a delivery delay
Record the original timing and subsequent messages. A manufacturer release date and a retailer delivery commitment are not necessarily the same thing. Check whether the order specified a binding date or merely an estimate. Under section 323 of the German Civil Code, an unsuccessful reasonable additional deadline can generally matter for withdrawal from a contract because performance is missing; exceptions can apply. This article does not prescribe a universal deadline length. Seek advice when disputed and keep dated communications rather than sending several inconsistent demands without a clear record.
Keep the order understandable
Separate factual questions from legal declarations. You can first ask for the current delivery status and identify the product version ordered. Keep your order number and contact route ready without posting unnecessary personal details publicly. For multiple pre-ordered items, check whether combined or separate dispatch was agreed. Retain proof of payment and responses. Do not immediately discard a resolved enquiry if a refund may still need reconciling. Buy a replacement only after understanding whether the original order remains active and what financial commitments are still outstanding.
Your buying note in five steps
Open the matching search for Pokemon and select one offer first. For your private note, copy the full product title and add the language, quantity and product format. Leave missing information unresolved. Do not fill a gap using an image or another store’s description. This helps you compare the merchandise actually described and explain the variant you mean if you need to ask a question. The note is especially useful when several browser tabs show very similar names but different products or quantities.
Record costs and your decision
Write down the item price and shipping quoted for your destination separately. Add any further costs visible in the specific checkout instead of relying only on a discount percentage. Then record your own maximum price and purpose: opening, playing, gifting or collecting. Choosing to wait is a complete outcome as well. A search result, a newly announced date or a notification does not by itself create a need to buy or provide a guarantee about what a product will cost in the future.
After comparing
Finally, check the retailer’s delivery status, payment method and actual contents once more. If you order, retain the confirmation and verify that the language and quantity match your notes. When something differs, ask a factual question and record the response. If you spot a mismatch in the comparison service, keep the product link and a concise description of the problem. A careful comparison ends with an understandable decision and traceable information. It does not have to end with placing an order or increasing your original spending limit.
FAQ
Does the word “pre-order” automatically remove withdrawal rights?
The label alone does not answer that. Relevant legal conditions and exceptions need checking.
Does this guide apply worldwide?
No. It addresses general questions in a German-law context and does not replace individual advice.
